This Privacy Notice outlines the personal information that Amplifon may collect, how Amplifon uses and safeguards that information, and with whom we may share it.

What personal information do we collect about you?

Collection of User Generated Content

We may invite you to post content on the Service, including your comments, testimonials, and any other information that you would like to be available on the Service, which may become public (“User Generated Content”). If you post User Generated Content, all of the information that you post will be available to authorized personnel of Amplifon. You expressly acknowledge and agree that we may access in real-time, record and store archives of any User Generated Content on our servers to make use of them in connection with the Service. What are the sources of personal information collected by Amplifon?

When providing personal information to Amplifon as described in this Privacy Notice, that personal information is primarily collected directly from you. Amplifon can also collect personal information about you from third party social networking services, publicly accessible sources, Amplifon subsidiaries or affiliates, or third-party service providers and other partners. The information provided by you and the information collected from other sources can be combined as your personal information.

How does Amplifon use personal information?

Subject to the terms of this Privacy Notice, Amplifon uses the above described categories of personal information in several ways. Unless otherwise stated specifically, the above information may be used for any of the following purposes:

to provide treatment, test hearing, and/or provide hearing aids;

to send you appointment reminders, and/or other information associated with your care;

to respond to and process your requests;

to distribute communications relevant to your use of the Service, such as system updates or information about your use of the Service; as may be necessary to support the operation of the Service, such as for billing, account maintenance, and record-keeping purposes; to notify you about changes to this Privacy Notice; to send to you Amplifon solicitations, product announcements, and the like that we feel may be of interest to you (you may “opt out” of receiving these marketing materials);

to allow you to participate in surveys or provide testimonials; to carry out Amplifon’s obligations and enforce rights arising from any contracts between you and Amplifon; to investigate and deter fraudulent activity; in other manners compatible with the above purposes, after subsequent notice is provided to you, or after your consent is obtained, if necessary.

 

How do we share your Personal Information with third parties?

We may provide any of the described categories of personal information to Amplifon employees, consultants, affiliates or other businesses or persons for the purpose of processing such information on our behalf in order to provide the Service to you. In such circumstances, we require that these parties agree to protect the confidentiality of such information consistent with the terms of this Privacy Notice.


We may disclose information to third parties in accordance with this Privacy Notice. The third parties we may disclose your information to include:


Other care providers in order to coordinate your care;

hearing aid manufacturer representatives, to assist in the selection, fitting, programming, or adjustment of your hearing aids;

unless you object, we may share limited health information with a person such as a family member if necessary as a part of care;


Third parties and service providers (e.g. providing products and services, advertising and marketing, data analysis, enhancing the information collected about you);

Subsidiaries and affiliates;

Direct marketing providers;


We will not share your personal information with other, third-party companies for their commercial or marketing use (except as may be described in this Privacy Notice) without your consent except if the information is to be used as part of a specific program or feature for which you have the ability to opt-in or opt-out.

Retention of Data

Amplifon will retain your personal information only for as long as is necessary for the purposes set out in this Privacy Notice. To determine the appropriate retention period for your personal information, we will consider the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of your personal information, the purposes for which we use your personal information and whether we can achieve those purposes through other means, and the applicable legal requirements.


Amplifon will also retain usage data for internal analysis purposes. Usage data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of the Service, or we are legally obligated to retain this data for longer periods.


Cookies and tags are small strings of text sent by our website(s) and/or mobile application(s) to your browser and then stored on your computer’s or phone’s hard drive or memory. A cookie/tag cannot retrieve data from your hard drive, pass on computer viruses, or capture your email address. These cookies/tags allow us to understand how you access and use our website(s), identify repeat visitors, and monitor the effectiveness of our marketing campaigns.


We may have relationships with third party vendors who use these cookies/tags to determine whether your IP address is in their database as having opted to receive promotional information from various merchants. If you opted in, you may receive materials about our products, services, promotions or other information. Your Choices Regarding Your Data

In addition to any privacy rights listed below, Amplifon allows you to make choices with regard to your personal information. You can make changes to your information, access your information, or delete your information. You have the right to opt out of email communications from Amplifon. Each email incudes opt-out instructions that you can use to stop receiving these communications, or you can contact the Compliance Department directly. Requests made through the opt-out instructions may take up to 10 days to process.


Amplifon sends autodialed marketing text messages to devices that have opted into receiving them. Opting into text messages is not a condition of purchase. If you would like stop receiving text messages from Amplifon, you can respond to any of our text messages with ‘STOP’ or contact the Compliance Department directly. Requests to opt out of text messages made through text message are effective immediately upon receipt. Standard message and data rates may apply.


Cookies, Device Data, and How it is Used

When you use our Service, we may record unique identifiers associated with your device (such as the device ID and IP address), your activity within the Service, and your network location. Amplifon uses aggregated information (such as anonymous user usage information, cookies, IP addresses, browser type, clickstream information, etc.) to improve the quality and design of the Service and to create new features, promotions, functionality, and services by storing, tracking, and analyzing user preferences and trends. Specifically, we may automatically collect the following information about your use of the Service through cookies, web beacons, and other technologies:

We may permit these service providers to use cookies and other technologies to perform these services for Amplifon. We do not share any personal information about our customers with these third-party service providers, and these service providers do not collect such information on our behalf. At this time, we do not respond to “Do Not Track” signals sent from Web browsers or other mechanisms that provide users the ability to exercise choice regarding the collection of personally identifiable information about a user’s online activities over time and across third party internet services.


Third Party Ad Networks

Amplifon uses third parties, such as network advertisers, to serve advertisements on third party websites or other media (for example, a third-party social networking service). This enables Amplifon and these third parties to target advertisements to you for products offered by us and products and services offered by third parties in which you might be interested. Third party ad network providers, advertisers, sponsors, and/or traffic measurement services may use cookies, JavaScript, Web beacons, flash cookies or Local Shared Objects and other tracking technologies to measure the effectiveness of their ads and to personalize advertising content to you. This Privacy Notice does not apply to them, and we cannot control their activities. You should consult the respective privacy policies of these third-party ad servers or ad networks for more information on their practices and for instructions on how to opt-out of certain practices. For example, you may go to the Digital Advertising Alliance (“DAA”) Consumer Choice Page  for information about opting out of interest-based advertising and choices regarding having information used by DAA companies. International Data Transfer

Amplifon is part of a global organization. As such, your personal information is shared with our affiliated companies, including our parent company Amplifon (USA), Inc. or affiliates including Miracle-Ear, Inc. in the United States, or Amplifon (USA), Inc.’s parent company, Amplifon S.p.A. in Italy for business operations and administration purposes. Your personal information is stored on servers located in the United States and in the European Union and may be stored in other jurisdictions. It may be accessible to law enforcement and other authorities within those jurisdictions. In addition, our service providers may be located outside of the territory of Canada, and while in a foreign jurisdiction. Our service providers are contractually obligated to use such information solely to provide services to us for the purposes for which we have collected your personal information, and to provide the same level of protection for your personal information that we are obligated to provide.


Canadian Privacy Rights

We employ industry-standard security measures designed to protect the security of all information submitted through the Service. The Service is not intended for children under the age of 13, and Amplifon does not knowingly collect the personal information of children under the age of 13.
